DMCA

At FloraWhisper, we strictly adhere to the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws. If we receive a valid DMCA notice, we will take appropriate action by removing or disabling access to the allegedly infringing material. We may also provide the uploader of the content with a copy of the notice, including the complainant’s contact details, to facilitate resolution.

If you believe that your content was removed due to a mistake or misidentification, you may submit a counter-notification that includes the following information:

  • Identification of the removed content, including its location prior to removal (e.g., URL or other specific reference).
  • Your contact details, including full name, mailing address, phone number, and email address.
  • A statement, under penalty of perjury, affirming that you have a good faith belief that the material was removed mistakenly or was misidentified.
  • A declaration consenting to the jurisdiction of a U.S. federal district court in which your address is located (or any other relevant jurisdiction) and agreeing to accept service of process from the original complainant.
  • Your physical or electronic signature, verifying the authenticity of your counter-notification.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If they do not initiate legal proceedings within 10-14 business days, we will restore the content.

Please note that knowingly misrepresenting claims in either a DMCA takedown request or a counter-notification may result in legal liability.
